Commissioners will take no action on easements |

By Rusty Nixon Correspondent PLYMOUTH — No action is good action to residents of Pleasant Point Beach at Lake of the Woods. Concerns had arisen by several residents of the subdivision over access to the lake for their properties. At contention were easements at certain points on the lake to allow property owners away from the shore access to the water.
The question arose over whether the easements were county property and just who had control over them. The issue has become a contentious one all around Lake of the Woods as allegedly non-residents have gone as far as to build piers at certain access spots and are mooring non-registered boats there. The Pleasant Point Beach situation has been looked at as a precedent for action at other spots on the lake. Whatever action is taken, it will not involve the Marshall County Commissioners as they ruled that they have no jurisdiction in the matter of who owns or controls the easements. Residents had asked the Commissioners to look at the situation and after consultation of the county records of the area by Surveyor Larry Fisher, there is no clear ownership by the county. Fisher said that certain roads within the subdivision were dedicated to the county in 1927 and 1941, but he could find no record that the county had ever accepted them. He did say that there was an “implied” acceptance since county trucks maintain the roads and plow snow in the winter time. Fisher did say that he felt each such situation around Lake of the Woods should be treated individually on a case by case basis. President of the Commissioners Kevin Overmyer assured the residents that “…we are certainly not looking at doing away with any access to any of the lakes in the county…” and said that interpretation of ownership and the law was not the jurisdiction of the board. The Commissioners told residents that those questions would have to be answered by the courts, but that they would take no action in the matter.
